ElysiumDS v1 — END USER LICENSE AGREEMENT

Mandatory. Non-negotiable. Binding upon acknowledgment.
By accessing, using, or interacting with ElysiumDS v1 (the "Software"), you—the "Operator"—enter into this binding End User License Agreement with ZERØ DIVISION LTD (an Ontario corporation, "Zero Division"). This is a license, not a sale. Zero Division retains all right, title, and interest in the Software and all its components.
1. Age and Capacity
You represent and warrant that you are at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher) and possess full legal capacity to enter this agreement. This Software is designed for mature creative use by adults only. Minors are strictly prohibited. Any false representation of age voids this agreement immediately and exposes you to legal consequences in your jurisdiction.
2. Intellectual Property Ownership & Copyright
The Software, including all code, design, UI, prompt logic, Furnace Patch System, Sovereign Forge engine, Archive Vault, visual assets, and all components, is the exclusive intellectual property of ZERØ DIVISION LTD, protected by the Canadian Copyright Act, the Berne Convention, and all applicable international law.

No ownership transfers to you. The copyright notice and this EULA must remain intact in any permitted copy.
3. License Grant
ZERØ DIVISION LTD grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Software for personal, non-commercial purposes only on your own device. Commercial use, resale, distribution, or offering the Software as a service requires a separate written commercial license from ZERØ DIVISION LTD.
4. Strict Prohibitions
You covenant never to: (a) copy, reproduce, modify, adapt, reverse engineer, decompile, or create derivative works of the Software; (b) remove, obscure, or alter any copyright or proprietary notices; (c) distribute, sell, rent, lease, sublicense, or transfer the Software or its code to any third party; (d) use the Software to build competing tools or services; or (e) circumvent any technical protection measures. Any such act constitutes immediate termination of this license and may result in legal action under Canadian and international copyright law.
5. Third-Party API Providers — Sovereign Forge Disclosure
The Sovereign Forge feature facilitates connections to third-party image generation APIs ("Providers"), which may include AI Horde, Stability AI, fal.ai, and others. Zero Division is not a party to your relationship with any Provider. By using Sovereign Forge, you acknowledge:
(a) Bring Your Own Key (BYOK): You are solely responsible for providing, securing, and complying with the terms and acceptable use policies of your chosen Provider's API key. Zero Division provides no API keys and assumes no responsibility for your compliance with any Provider's Terms of Service. All API keys are stored only in your local browser storage — Zero Division never transmits them to any Zero Division server.
(b) Provider ToS Agreement: Before entering an API key for any Provider, the Software presents that Provider's Terms of Service for your review and requires your explicit agreement. By confirming, you represent that you have read and agree to that Provider's terms. Zero Division is not responsible for enforcing or monitoring your compliance.
(c) Anonymous / Default Access: Where a Provider supports unauthenticated access (e.g., AI Horde anonymous mode), the Software may default to that mode when no key is supplied. Such access is governed solely by the Provider's policies. Your EULA acceptance covers this use.
(d) Data Practices: Providers may collect, process, share, or retain your prompts and generated images according to their own privacy policies. Zero Division has no access to or control over these data flows. You are responsible for reviewing the applicable Provider privacy policy before use.
(e) No Control: Zero Division does not own, operate, control, or endorse any Provider's infrastructure, models, moderation, pricing, or availability. Provider services may be modified, suspended, or terminated at any time without notice to Zero Division.
(f) Content Filters: Certain Providers operate mandatory content filters (including CSAM detection) at the network level. Zero Division cannot disable or override these filters.
(g) No Warranty of Output: Zero Division makes no warranties regarding the content, quality, legality, availability, or fitness of any outputs generated via third-party Providers.
6. Protection of Real Persons — NCII Strictly Prohibited
You covenant never to use ElysiumDS v1 to create, modify, or distribute non-consensual intimate imagery (NCII), deepfakes, or synthetic depictions of any real, identifiable living or recently deceased individual without their explicit, informed, documented consent. You will not generate content depicting minors in any sexual, exploitative, or harmful context. Any such use is your act alone, constitutes a breach of this agreement, and may constitute a criminal offence under applicable law.
7. No Illegal or Prohibited Use
You will not use the Software to generate or distribute content that is illegal under the laws of your jurisdiction or any jurisdiction in which you disseminate it, including content violating hate speech laws, privacy laws, or applicable criminal codes.
8. Disclaimer of Warranties
The Software and all outputs are provided "AS IS" and "AS AVAILABLE" with no warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. Zero Division does not warrant that the Software will be uninterrupted, error-free, or free of harmful components.
9. Limitation of Liability
To the maximum extent permitted by applicable law, the total liability of ZERØ DIVISION LTD to you shall not exceed the greater of: (a) the amount you paid for access in the twelve months preceding the claim; or (b) CAD $1.00. In no event shall Zero Division be liable for indirect, incidental, special, consequential, or punitive damages of any kind.
10. Indemnification
You agree to indemnify, defend, and hold harmless ZERØ DIVISION LTD and its directors, officers, and agents from any claims, damages, losses, costs, or legal fees arising from: (a) your use or misuse of the Software; (b) any output generated through your use of the Software, including outputs produced by third-party Providers at your direction or as a result of your prompt inputs; (c) your violation of this EULA; or (d) your violation of any third party's rights. For clarity, this indemnification does not extend to output produced autonomously by a Provider's content safety system independently of your prompt inputs.
11. Assignment
ZERØ DIVISION LTD reserves the right to assign, transfer, or sublicense this Agreement and all rights herein, in whole or in part, to any successor entity, acquirer, or affiliate without notice to or consent from you. Your rights under this Agreement are personal and may not be assigned or transferred.
12. Governing Law & Jurisdiction
This EULA is governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles. You irrevocably submit to the exclusive jurisdiction of the courts of Ontario for any dispute arising hereunder, except where mandatory applicable consumer protection law in your jurisdiction of residence confers a non-waivable right to bring proceedings before your local courts, which this clause does not purport to waive.
13. Severability
If any provision is held unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable. All remaining provisions continue in full force and effect.
14. Survival
Sections 2, 4, 5, 6, 8, 9, 10, 11, and 12 survive any termination of this Agreement.
15. Entire Agreement & Authorship Acknowledgment
This EULA is the entire agreement between you and ZERØ DIVISION LTD regarding the Software. You acknowledge that ElysiumDS v1 was authored by pauly zero operating through ZERØ DIVISION LTD under his sole creative direction; all selection, arrangement, expression, and creative choices are original human-authored work. AI tools were used solely as assistive instruments under direct human control, with all protectable expression originating from human authorship — protectable under 17 U.S.C. §102 (US), the Canadian Copyright Act, and applicable international law — and that unauthorized use or distribution of this code is infringement of that IP.
16. Consent — Method of Acceptance
By manually entering or pasting the exact acceptance phrase into the designated confirmation field and affirmatively checking all five (5) acknowledgment checkboxes below, you are executing a binding contractual act equivalent to a physical signature. You acknowledge that: (i) reproducing the acceptance phrase — whether typed or pasted — in the confirmation field constitutes your deliberate, informed assent to every term of this Agreement; (ii) the Software requires you to scroll through the full text of this Agreement before the acknowledgment fields are activated, giving you a meaningful opportunity to read it; (iii) this method of acceptance satisfies any applicable writing or signature requirement; and (iv) if you did not intend to accept these terms, you must immediately cease use of the Software and clear your browser's local storage (key: zd_eula_accepted_v1).
17. Data Practices Cross-Reference
You acknowledge that you have been presented with a separate Data & Privacy Disclosure within the Software interface describing all local storage operations, third-party CDN transmissions (including IP address transmission to Google Fonts and Cloudflare CDN which occurs on page load prior to this acceptance), and third-party data flows associated with your use. Your acceptance of this Agreement constitutes acknowledgment of those disclosed data practices.
